Petty Short and Well Laid Out

What an utterly awesome End-User Licence Agreement:

I don’t normally go for shooty-shooty games, but a colleague plays this silly tank game so I thought I’d give it a look, so he’ll have chance to blow me up.  A lot, I’ve no doubt.  But at this point, I haven’t given it a look yet, as I’m just reading the EULA – but my, what an EULA.

Most games publishers seem determined to draw up as long and complicated an agreement as they possibly can, using as much legalese as they possibly can, apparently to ensure that as few users as possible actually read it before clicking that they agree.  (I’m still not sure of the legal weight of a ‘contract’ you haven’t actually signed; but the games industry seems to take it as read that they’re sacred writ once accepted.)

But this one?  Brilliant.  It’s pretty short; it’s well laid out; it’s clearly worded; and it even defines some of the standard words these agreements always include:

  1. In return for your acceptance of this EULA, we give you the personal right (known as a ‘licence’) during the time this EULA is in force between you and us to download, install and play the Game.
  2. This licence is:
    1. ‘non-exclusive’ (meaning that we can grant the same and similar licences to other people as well); 
    2. ‘revocable’ (meaning that we can terminate this licence in certain circumstances, which are explained further below);
    3. ‘personal’ (meaning that you may not use the Game for any commercial purpose);
    4. ‘non-transferable’ (meaning that the licence is only for your benefit and you may not transfer or sublicense any of the rights that we grant to you to any other person); and
    5. ‘limited’ (meaning that you can only use the Game for the purposes we set out in this EULA); and
    6. conditional on your compliance with this EULA.

Could that lot be any clearer?

And no, this isn’t sarcasm.  I genuinely am impressed.
